Cooperation between Ombudsman and the Coordination center for providing legal assistance is enlarged


For the purpose of deepening of cooperation between the Commissioner for Human Rights and the Coordination center for providing legal assistance Annex to the Memorandum of cooperation, which was concluded on December 10, 2013, was signed.

Within last year interaction within the signed Memorandum demonstrated the efficiency and practical productivity. In particular, during drama events which occurred in Ukraine in November, 2013 – February, 2014, in close cooperation with the public and the Coordination center for rendering legal assistance became possible to verify quickly information concerning each detainee, to assist to search for missed persons, to verify messages concerning human rights violations. During that time there were serious problems when employees of law enforcement bodies didn't allow lawyers to visit detainees, and in many cases thanks to employees of Department for realization of the national preventive mechanism of the Secretariat of the Commissioner lawyers nevertheless were allowed to fulfill their obligations for protection of activists. Within realization of NPM employees of the Secretariat together with public monitors while carrying out monitoring visits to places of detention  revealed repeatedly cases of not informing of centers for providing free secondary legal assistance concerning cases of detention of persons, attention of heads of the relevant departments in the reports upon results of the carried-out visits was drawn to this facts.

Considering the revealed problematic issues and for the purpose of more effective interaction within the existing Memorandum, annexes were made which contain in part of expansion and deepening of the directions of cooperation.

Thus, the agreement was achieved upon:

•  elaboration of a technique of prevention and suppression of cases of detention of persons without appropriate registration of their status and adjustment of exchange of information, necessary for identification of such cases;

• informing the centers for providing the free secondary assistance in a case of identification  while exercising parliamentary control over observance of the rights and freedoms of the person of poor quality of providing such assistance by lawyers;

• introduction of mechanisms of cooperation concerning prevention of practice of tortures and others cruel, inhuman or degrading treatment or punishment concerning persons having the right for free legal assistance by expeditious providing by the centers for providing free secondary legal assistance information concerning such cases to the Commissioner for Human Rights.
